Please read these terms carefully before using the Katos India platform. By using our services, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using the Katos India Pvt. Ltd. website, mobile application, or any related services (collectively, the "Platform"), you agree to comply with and be bound by these Terms & Conditions. If you do not agree to these terms, please do not use the Platform.

2. Services Provided

Katos India Pvt. Ltd. provides a digital platform that connects users ("Customers") with independent third-party transportation providers ("Drivers" and "Vendors"). We facilitate the booking, tracking, and payment of rides but do not provide transportation services ourselves. All transportation services are provided by independent third-party contractors.

3. User Accounts

To access certain features of the Platform, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update it promptly.

4. Booking and Cancellation

  • Booking: When you book a ride through the Platform, you agree to pay the fare displayed at the time of booking, plus any applicable taxes, tolls, or surcharges.
  • Cancellation: You may cancel a booking free of charge within 5 minutes of confirmation. Cancellations after this period may incur a cancellation fee as displayed on the Platform.
  • No-Show: If you fail to show up at the designated pickup location within 10 minutes of the driver's arrival, the booking will be considered a no-show and may be subject to a cancellation fee.

5. Payments and Fees

All payments are processed securely through our payment partners. You authorize Katos India Pvt. Ltd. to charge your selected payment method for all fares, fees, and charges incurred. Fares are calculated based on distance, time, and demand. We reserve the right to modify fares and fees at any time with prior notice.

6. User Conduct

You agree to use the Platform only for lawful purposes. You shall not:

  • Use the Platform for any illegal or unauthorized purpose.
  • Harass, abuse, or harm any driver, vendor, or other user.
  • Interfere with or disrupt the Platform or its servers.
  • Attempt to bypass any security measures or gain unauthorized access.
  • Post or transmit any offensive, defamatory, or obscene content.

7. Driver and Vendor Terms

Drivers and vendors are independent contractors and are not employees of Katos India Pvt. Ltd. They are solely responsible for their compliance with all applicable laws, regulations, and licensing requirements. Katos India Pvt. Ltd. does not control or guarantee the quality, safety, or legality of the services provided.

8. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, and software, is the property of Katos India Pvt. Ltd. or its content suppliers and is protected by Indian and international copyright laws. You may not reproduce, distribute, or create derivative works from any content without our prior written consent.

9. Disclaimer of Warranties

The Platform and services are provided "as is" and "as available" without any warranties of any kind, express or implied. Katos India Pvt. Ltd. does not warrant that the Platform will be error-free, uninterrupted, or secure, or that any defects will be corrected.

10. Limitation of Liability

To the maximum extent permitted by law, Katos India Pvt. Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform or services, including but not limited to loss of profits, data, or goodwill.

11. Indemnification

You agree to indemnify, defend, and hold harmless Katos India Pvt. Ltd., its directors, employees, and affiliates from any claims, liabilities, damages, losses, or expenses arising from your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We reserve the right to suspend or terminate your account and access to the Platform at our sole discretion, without prior notice, for any violation of these Terms or for any other reason we deem appropriate.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Noida, Uttar Pradesh.

14. Changes to Terms

We reserve the right to update or modify these Terms at any time. Any changes will be effective upon posting on the Platform. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms.
